Terms of Cooperation for the Construction and Development of Websites and Webpages
Acceptance of the terms of cooperation
For the acceptance of the terms of cooperation, it is not necessary for the customer to have signed a document. If the Client accepts our cooperation or accepts an offer we have sent him, he automatically accepts these terms of cooperation regarding the construction and development of websites and web pages.
Please read these terms carefully. Use of our services means that you have read and accepted these terms and conditions.
From now on, the term“Website” for the sake of brevity, will refer to: Webpage, Website, Online Shop (eshop).
Tools we use to build websites
The client accepts that the website will be built using WordPress and Woocommerce, unless otherwise stated in the offer received.
At AlterMarket we believe that WordPress and Woocommerce meet the needs of 99% of customers.
In addition, the ease of management offered by WordPress and Woocommerce add additional value to the Client’s investment.
The Customer accepts that plugins and themes from third party manufacturers will be used for the design of the website. Add-ons and themes for which AlterMarket has no direct control or say in their development. AlterMarket does not accept any liability for current or future compatibility of these plug-ins and themes with current or future versions of the Customers’ websites.
The Customer accepts that there may be additional charges for the adaptation of current and future versions of the add-ons and themes on its website.
Charges
The charges for the services that the Customer will receive are indicated in the offer received by email or in writing. Quotations are valid for 30 days from the date indicated in the quotation. AlterMarket reserves the right to modify or cancel the offer after the 30 days.
Unless otherwise agreed with the Client, all web design services require a minimum deposit of 50% or 200€ (whichever is higher) of the offered work cost. Only then will the Client have access to the website under construction for evaluation and testing.
The balance of the offered work cost is paid by the Client upon delivery of the website or 30 days from the start of the work (whichever is sooner), and always before the final delivery of the public website.
The Customer receives preferential invoices by email that can be paid by one of the following methods: bank deposit, credit or debit card, Paypal.
AlterMarket will provide the Client with the opportunity to control the appearance and content of the website during the design phase and once the overall development of the website is completed. The Customer, may express its objections in writing within ten (10) days of delivery of the Website.
Delivery time and content control
AlterMarket will deliver and make publicly available the Customer’s website on the date agreed in the offer, or on the date agreed with the Customer after receipt of the deposit.
The Client agrees to appoint a contact person with whom the communication on the progress of the website construction project will be carried out. The contact person will provide in electronic form all the material requested for the creation of the website (texts, photos, drawings, PDF, video, audio files, etc.) and will be the one who will report comments on the project.
During the project, AlterMarket may request the Customer to provide all or part of the content of the website in electronic form: texts, photos, PDF documents, videos, audio files, etc.
Material delivery failure for the website
In order to remain efficient and useful to our Clients, we must meet the deadlines set for the projects we undertake. There are occasions when we turn down new projects and partnership proposals in order to be consistent with the projects we have already undertaken in order to be consistent with our Clients.
This is why we ask you to provide us with all material for your website at least 10 working days before the agreed completion date. If through your own fault the project cannot be completed within the agreed timeframe and there is a delay, we reserve the right to claim an additional 25% compensation on the agreed price.
If your project includes search engine optimization (SEO), we need to have pre-agreed the texts of the website content in order to plan and implement the necessary actions.
If you agree to provide us with the required information and materials, but you are unable to keep your promise by 10 working days before the delivery date of the project, we reserve the right to cancel the project and demand immediate payment of the balance. Simply put, what all of the above terms say is: don’t commission us to build your website if you are not ready first.
NOTE 1: Texts must be provided in Ms Word document format or compatible with it (e.g. LibreOffice, OpenOffice). The pages/files of the texts must correspond to the relevant pages of the website. Please contact us if you would like clarification on this.
NOTE 2: On the websites we build with WordPress, if you know how it works, it’s easy to update the texts yourself after delivery. Keep the content up to date.
Copyright Copyright
The Customer retains the copyright to all material (such as texts, photos, logos, videos, etc.) provided to AlterMarket for the construction of its website. The Customer gives AlterMarket the right to use and publish this material. It is Customer’s responsibility to obtain the licenses and copyrights for the material it provides to AlterMarket. Customer agrees to protect AlterMarket from any claims arising from its own negligence to obtain the licenses and copyrights for the material it provides to us. AlterMarket reserves the right to request evidence of Customer’s right to use on the Website the material provided by Customer.
Method of Material Delivery
The texts must be in Ms Word or a format compatible with it (e.g. LibreOffice, OpenOffice).
Photos and graphics must be in .jpg, .png, .gif, .svg format.
The material is sent via email, FTP, Cloud services, USB stick.
AlterMarket reserves the right to charge extra for adapting the material provided by the Customer so that it can be posted on the website. E.g. editing of photos, graphics, video, texts.
AlterMarket is not obliged to return the material to the Customer.
Reference to AlterMarket
In the footer of the Client’s website there may be a reference to the website developer which is AlterMarket. The reference will be in the form of text that will act as a link to Altermarket’s website. If the Client does not wish to have this reference, the Client must explicitly state this in writing prior to the completion of the project. The Client also agrees that its website may be featured by AlterMarket on its client list.
Third Party Server Access Requirements
If the Customer’s website will be hosted on a third party server, the Customer will need to give us access to their account. The access may be in the form of FTP and/or in the control panel of the hosting plan they have.
In this case, AlterMarket cannot guarantee that the server used by the Customer is fully compatible with the requirements for the operation of the website.
Changes After the Website is Uploaded
AlterMarket does not accept responsibility for any changes made to the Customer’s website by third parties after it has been posted. Such changes include but are not limited to: additions, changes and deletions to content, add-ons, themes, etc.
domain name
AlterMarket may register a domain name on behalf of the Customer. The payment and renewal of these domain names is the responsibility of AlterMarket after it has received the relevant payment from the Customer. The loss of the domain name due to invalid payment by the Customer and any losses incurred are not AlterMarket’s responsibility. It is the Customer’s responsibility to make timely payment for the renewal of the domain name.
Browsers (Web Browsers)
Altermarket makes every effort to ensure that the websites it designs are displayed correctly to the majority of visitors. The websites we build are designed to be compatible with the majority of popular browsers (e.g. Firefox, Google Chrome, Edge, etc.). Customer agrees that AlterMarket cannot guarantee compatibility of its website with all browsers on all different operating systems.
AlterMarket does not accept responsibility for websites that do not display correctly in old browser versions or for browser versions that have been released after the website was posted. AlterMarket reserves the right to request an additional charge from the Customer to adjust the appearance and code of the website in these cases.
Payments
AlterMarket initially sends the Customer a preference list via email.
After the payment of the preferential invoice, the Customer receives the relevant Service Invoice (ISP).
For preferential tariffs that have not been paid 30 days after their expiry, we reserve the right to charge an additional 5% or 30€ per month (whichever is higher) for administration costs.
Additional Expenses
The Customer agrees to reimburse AlterMarket for any additional costs necessary for the completion of the website. Examples of such expenses are: purchase of photos, add-ons, themes, fonts, translations, etc.
Default of payment
Charges that have not been paid 30 days after the expiry of the preferential tariff are considered as defaulted. If a Customer who has defaulted on payment maintains web pages, emails, files or information on AlterMarket’s servers, AlterMarket reserves the right to delete them without prior notice. AlterMarket is not responsible for any loss of Customer. Deletion does not negate Customer’s obligation to pay AlterMarket for its services, together with any additional charges.
Customers with defaulted accounts agree to pay AlterMarket any additional costs incurred in receiving payments.
Termination of Cooperation
The termination of the cooperation must be requested by the Customer in writing or by email; it will be effective from the next working day of receipt of the request. Telephone or verbal requests for termination of cooperation will not be accepted until accompanied by a written or email request. The Customer will be charged for any work in progress.
Compensation
All services provided by AlterMarket can only be used for legitimate uses. The Customer agrees to indemnify AlterMarket and keep AlterMarket out of any legal adventures and proceedings arising as a result of his/her use of our services.
Web Hosting Services
Payment terms for web hosting services
The payment period for web hosting services starts on the day of the creation of the Customer’s hosting plan.
Shared Web Hosting services are paid per year, unless otherwise agreed.
VPS, Dedicated Hosting, Cloud Hosting services are paid per month.
AlterMarket sends the Customer a relevant preference list via email.
For the termination of web hosting services by AlterMarket, a 30-day written notice is required. It can be sent by email.
AlterMarket reserves the right to change the prices for web hosting services by informing the Customers at least 30 days before the scheduled date of the price change.
AlterMarket reserves the right to discontinue web hosting services at any time.
Right to Change the Terms of Cooperation
AlterMarket reserves the right to change the terms of cooperation.
The new terms of cooperation are valid 15 days after they are posted on its website.
The date of the last change of the terms of cooperation is indicated at the end of this document.
By continuing to work with AlterMarket, it means that you accept the new terms.
Right to Change Prices
AlterMarket reserves the right to change the prices of the services it provides. For new customers, the new prices are effective immediately. For existing customers, the new prices are valid 15 days after they are posted on the website.
Competent Courts
The Customer agrees that for any dispute arising from the use of its services, the laws of the Greek state will apply and the competent court for the resolution of such disputes will be the Courts of Athens.
